The court said it ruled that James Charles Kopp, 46, could be extradited to the United States based on assurances the U.S. government will not seek the death penalty.
France, which abolished capital punishment 20 years ago, does not extradite suspects who face the death penalty at home.
Kopp denies shooting Dr. Barnett Slepian, 52, through the kitchen window of Slepian´s house in suburban Buffalo, New York. Kopp has until Wednesday to decide whether to appeal to France´s highest court. The appeals process could take months.
